Wniosek o zwrot podatku VAT
Wniosek należy złożyć na właściwym formularzu wypełnionym w języku polskim.
Formularz wypełnia się DRUKOWANYMI LITERAMI, zaczynając każdy wpis na początku
wiersza lub rubryki.
W rubrykach typu |_|_|_|_|_|_| wstawia się nie więcej niż jeden znak (literę, cyfrę, znak
przestankowy itp.).
Wniosek składa się do Naczelnika Drugiego Urzędu Skarbowego Warszawa-Śródmieście, nie
później niż do dnia 30 czerwca roku następującego po roku podatkowym, którego wniosek
dotyczy.
Jeżeli nie jest to pierwszy wniosek, należy podać numer ewidencyjny nadany w Polsce.
Numer ten winien być umieszczony w ramce w lewej górnej części wniosku.
Wniosek winien dotyczyć zakupów towarów i usług lub importu towarów zrealizowanych w
okresie nie krótszym niż 3 miesiące i nie dłuższym niż rok podatkowy. Wniosek może
dotyczyć okresu krótszego, w przypadku gdy dotyczy ostatnich 3 miesięcy roku
podatkowego.
Wniosek może dotyczyć więcej niż jednej faktury lub dokumentu importowego. Jeżeli
wniosek dotyczy okresu krótszego niż rok podatkowy, ale nie krótszego niż 3 miesiące kwota
wnioskowanego zwrotu podatku nie może być niższa niż kwota stanowiąca równowartość w
złotych - 200 euro. W przypadku gdy wniosek dotyczy całego roku podatkowego lub okresu
krótszego niż ostatnie 3 miesiące tego roku, kwota wnioskowanego zwrotu podatku nie może
być niższa niż kwota stanowiąca równowartość w złotych - 25 euro.
Przeliczenia kwot wyrażonych w euro dokonuje się według średniego kursu euro ogłaszanego
przez Narodowy Bank Polski, obowiązującego w ostatnim dniu okresu, za jaki składany jest
wniosek.
W poz. 10 w rubryce drugiej w lit. a podmiot uprawniony winien opisać rodzaj prowadzonej
działalności, w ramach której nabył towary i usługi, tj. oświadczyć, że towary i usługi
wyszczególnione w poz. 11 zostały wykorzystane do tej działalności jako podatnika w okresie
........, np. „Udział w Międzynarodowych Targach .............., które odbyły się w ............... w dniach ................. Stanowisko nr ............” lub „Międzynarodowy przewóz towarów z
............... do ............... środkiem transportu ...............”
W poz. 10 w rubryce drugiej w lit. b druga (*) podmiot uprawniony winien oświadczyć, że
jedynie świadczył usługi lub dokonywał dostaw towarów, o których mowa w § 2 ust. 1 pkt 3
rozporządzenia.
Do wniosku dołącza się między innymi:
- oryginał zaświadczenia wskazującego, że podmiot uprawniony jest podatnikiem podatku
od wartości dodanej lub podatku o podobnym charakterze, zarejestrowanym w kraju
siedziby lub miejsca zamieszkania albo stałego miejsca prowadzenia działalności.
Zaświadczenie to wydaje organ podatkowy w kraju siedziby lub miejsca zamieszkania
albo stałego miejsca prowadzenia działalności podmiotu uprawnionego. Jeżeli podmiot
uprawniony składa wniosek częściej niż jeden raz w roku podatkowym, zaświadczenia nie
dołącza się do każdego wniosku, pod warunkiem że nie upłynął rok od dnia jego
wystawienia oraz nie nastąpiły żadne zmiany w zakresie objętym zaświadczeniem,
- oryginały faktur oraz dokumentów celnych, z których wynikają wnioskowane kwoty
zwrotu.
Kwoty zwrotu podatku uzyskane nienależnie przez podmiot uprawniony podlegają zwrotowi
do urzędu skarbowego wraz z należnymi odsetkami. W przypadku niedokonania zwrotu
podatku uzyskanego nienależnie wraz z należnymi odsetkami, podmiotowi uprawnionemu nie
przysługuje kolejny zwrot.
Zwrot podatku jest dokonywany w złotych polskich na rachunek bankowy podmiotu
uprawnionego w kraju lub w kraju jego siedziby albo miejsca zamieszkania lub stałego
miejsca prowadzenia działalności. W przypadku gdy zwrot podatku jest dokonywany na
rachunek w kraju siedziby lub miejsca zamieszkania albo stałego miejsca prowadzenia
działalności podmiotu uprawnionego, urząd skarbowy nie ponosi kosztów związanych z
dokonaniem tego zwrotu.

Complete the form in BLOCK LETTERS starting each entry at the beginning of the line or
space provided.
In those sections which are marked thus |_|_|_|_|_|_| do not insert more than one character
(letter, figure, punctuation mark etc.).
The application shall be submitted to the Head of the Second Tax Office for Warszawa-
Śródmieście not later than by 30 June of the year following the tax year to which the
application refers.
If this is not first application the reference number in Poland shall be given. This number
should be inserted in the box in the top left corner of the application.
The application should refer to purchase of goods and services or the import of goods made
during a period of not less than three months and not more than a tax year. It may relate to a
shorter period in case it concerns the last three months of a tax year.
The application may be used for more than one invoice or import document. If the period to
which the application relates is three months or more, but less than one tax year, the total
amount of tax refund for which application is made must not be less than PLN equivalent of
EURO 200. In case if the period is one tax year, or remainder of a tax year, the amount of tax
refund for which application is made must not be less than PLN equivalent of EURO 25.
The conversions of the amounts expressed in EURO shall be made in accordance with the
average EURO exchange rate published by the National Bank of Poland as for the last day of
the period for which the application is submitted.
In the item 10 of the second blank (letter a) the applicant should describe the nature of
activities for which goods were acquired or services received, i.e. he should declare that the
goods or services specified in item 11 were used for those activities as a taxable person
during......, e.g. „Participated in the International ............. Fair, held in ....... from .........
to ......... Stand No...........” or „International carriage of goods as from ....... to ........ on
............”
In the item 10 of the second blank (letter b second (*)) the applicant should declare only the
provision of services or the supply of goods, referred to in § 2 subparagraph 1 point 3 of the
Regulation.
Following documents shall be attached to the application:
- original certificate attesting that the eligible entity is a taxable person of the value added tax,
or of the tax of similar nature, registered in the country of their permanent establishment or
his domicile or the permanent place where activity is carried out. The certificate shall be
issued by the tax authority in the country of permanent establishment or his domicile or the
permanent place where activity of the eligible entity is carried out. In case where the eligible
entity files the application more frequently than once a tax year, the certificate shall not be
enclosed to each application provided that a year has not yet elapsed since the date of its
issue and no changes in the matters to which it refers have occurred;
- original invoices and customs documents on the basis of which the amount of tax refund for
which application is made is determined.
Tax which has been unduly refunded shall be reimbursed to the tax office along with interest
due. In case where the undue tax refund has not been reimbursed along with the interest due,
the eligible entity shall not obtain further tax refunds.
Tax refund shall be made in Polish zloty to the bank account of the eligible entity in Poland or
in the country of their permanent establishment or residence or the permanent place where
activity is carried out. In case where tax refund is made to the bank account in the country of
permanent establishment or his domicile or the permanent place where activity of the eligible
entity is carried out, the tax office shall not incur the bank charges for the transfer.
