Decyzja Europejskiego Trybunału Praw Człowieka z dnia 12 września 2019 r. 12409/15
Application no. 12409/15
Oleg Vasilyevich LITVINTSEV
The European Court of Human Rights (Third Section), sitting on 12 September 2019 as a Committee composed of:
Alena Poláčková, President,
Gilberto Felici, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 2 March 2015,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Oleg Vasilyevich Litvintsev, was born in 1968.
The applicant was represented by Ms K. Moskalenko, a lawyer admitted to practise in Moscow.
The applicant's complaints under Article 6 §§ 1 and 3 (b) and (c) of the Convention that he was unable to participate effectively in the appeal hearing of 2 September 2014 were communicated to the Russian Government ("the Government").
On 31 July 2019 the applicant informed the Registry that he wanted to withdraw the application to the Court in view of his forthcoming release from prison in September 2019.
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
FOR THESE REASONS, THE COURT, UNANIMOUSLY,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 3 October 2019.
Acting Deputy Registrar
