Universal standards of procedural justice in disciplinary proceedings of officers of the State Protection Service (SOP)

On 8 December 2017, the Sejm of the Republic of Poland adopted the State Protection Service Act which governs the legal mechanisms of protection of persons performing the most important public functions . It establishes detailed rules of disciplinary proceedings in cases of disciplinary offences . The purpose of this article is to determine to what extent the newly adopted normative mechanisms correspond with the values realized by the universal standards of procedural justice and the basic principles characteristic of the democratic rule of law. In the axiological dimension, this article refers to Montesquieu’s view: Les formalites de la justice sont necessaires a la liberte.
