Bałos Iga, The Impact of AI on Patent Quality

The use of Artificial Intelligence (‘AI’) becomes increasingly widespread, which makes it one of the most topical issues in almost every possible area. In the context of patent law, the impact of AI is at least twofold. First, the question of the scope of patent protection with regard to AI-related inventions should be addressed. It is argued that patents are a poor fit for many AI systems due to patent eligibility and patentability requirements. Second, using AI as a tool is becoming more common for different stakeholders of the patent system. It impacts the existing rules on patentability and subject matter eligibility. All these factors contribute to overall patent quality.
