The exclusion of the court referendary in administrative court proceedings

Both administrative and common courts employees administer justice, performing legal protection tasks and court administration activities. Judges and judicial officers perform legal protection tasks.

As a result of the reform of administrative judiciary in 2002 the tasks within the scope of legal protection were given to judicial officers. The legislator defined the conditions to be met by a candidate for the post of judicial officer. According to Article 27 Paragraph 1 of LSAC a person fulfilling the following conditions can be appointed a judicial officer: Polish citizenship, full civil and citizen rights, a good character, law studies completed in Poland with the master's degree or foreign law studies recognized in Poland, three years' employment in the positions connected with the administrative law application or making. Judicial officer may be appointed senior judicial officer when he has performed the duties of the judicial officer for at least ten years, has not been punished...
