Terms initiate mediation proceedings on the complaint of Art. 101 and 101a of the Local Government Act

1.Introductory remarks

In accordance with art. 115 paragraph 1 of the Act of 30 August 2002 Law on proceedings before administrative courts at the request of the applicant or body, made prior to the determination of the hearing may be conducted mediation, whose purpose is to clarify and consider the facts and legal issues, and the adoption by the parties of understanding as to how to deal with the case within the limits of the law.

Mediation proceedings may be carried out despite the absence of a request the parties to conduct such proceedings (paragraph 2).

Cited above rules indicate the scope of the mediation and determine those who can initiate this particular mode of administrative litigation.

The subject of the mediation proceedings before the administrative courts may be all the matters referred to in art. 3 paragraph 2 administrative proceedings before the Court in which the complaint was lodged .
