Augustyniak Monika, Public consultations in municipal local government in Poland and France − the conclusions and proposals

The issues raised in this article present the problem of public consultations which are a form of participation of citizens in the exercise of power at the local level. The article includes the determination of the legal basis of the public consultations carried out in the basic unit of the local government, namely the municipality, by indicating the legal norms of the statutory rank and other legal acts and the subjective and objective scope of local consultations in Poland and France. The paper will present procedural elements, which ensure the proper execution of this basic form of social participation in both legal systems. What remains the issue of concern is also the determination of the scope of the binding form of expressing the will of local residents of the municipality through public consultations as well as the issue of challenging local consultations in the court.
