On the impact of lobbyists on the law-making process

1.Lobbying as a Way to Impact the Legislative Process as Defined in the Act

Being on the eve of the second decade following the adoption of the bill on lobbying , one tends to reflect critically not only on the pertinence of the enacted piece of legislation, but also on how lobbying works in practice, which seems to be important in the light of its negative (as it follows from public opinion polls) social perception.

While numerous critical analyses, both monographs and contributory papers, have been offered from a jurisprudential viewpoint, there are still few publications dealing with the practical aspects of that activity, which may be due to a number of factors, including gaps in the enacted legislation.

Proceeding to the opinions rendered from a jurisprudential viewpoint one has to start by citing statements according to which that the law concerned was necessary both for formal reasons, as it was expected to enhance the transparency of the legislative process, and for civic considerations, as lobbying in representative democracy is on principle intended...
