Making Music and Artificial Intelligence from the Perspective of Copyright Law

The ubiquity of new technologies in various spheres of life means that areas previously considered to be the domain of humans are increasingly being influenced by artificial intelligence. One of such fields is making music, which is changing under the influence of the emergence of more and more AI-based music software. Works created in this way often do not differ in artistic value from works composed by humans. Therefore, contemporary copyright law faces many challenges as traditional concepts of authorship are no longer fit for dealing with the changes taking place. This phenomenon forms the basis for the analysis of AI-based music software from the perspective of copyright law. The paper contains a subjective analysis of selected kinds of software and the ways of granting copyright in the works generated by such software. It also proposes how this issue might be regulated with regard to such works on a program-by-program basis.
