Consumer welfare objective in the GlaxoSmithKline judgment: an obstacle to the reform of Art. 102 TFEU?

The GlaxoSmithKline case is commonly presented amongst EU competition law commentators as an important judgment on interpretation of competition law goals. The ECJ's view on the goals of competition law in this case was said to pose limitations to introduction of a more economic effect-based approach to Art. 102 TFEU, which corresponds to attaching more weigh to the consumer welfare objective while seeking to protect undistorted competition. This essay challenges the common view that GlaxoSmithKline judgment constitutes an obstacle in applying the modernised approach.
