ROZPORZĄDZENIE KOMISJI (UE) NR 758/2013
z dnia 7 sierpnia 2013 r.
zawierające sprostowanie załącznika VI do rozporządzenia Parlamentu Europejskiego i Rady (WE) nr 1272/2008 w sprawie klasyfikacji, oznakowania i pakowania substancji i mieszanin
(Tekst mający znaczenie dla EOG)

KOMISJA EUROPEJSKA,

uwzględniając Traktat o funkcjonowaniu Unii Europejskiej,

uwzględniając rozporządzenie Parlamentu Europejskiego i Rady (WE) nr 1272/2008 z dnia 16 grudnia 2008 r. w sprawie klasyfikacji, oznakowania i pakowania substancji i mieszanin, zmieniające i uchylające dyrektywy 67/548/EWG i 1999/45/WE oraz zmieniające rozporządzenie (WE) nr 1907/2006 1 , w szczególności jego art. 53,

a także mając na uwadze, co następuje:

(1) W wyniku weryfikacji wykryto błędy w załącznikach I, II, IV i V do rozporządzenia Komisji (WE) nr 790/2009 z dnia 10 sierpnia 2009 r. dostosowującego do postępu naukowo-technicznego rozporządzenie Parlamentu Europejskiego i Rady (WE) nr 1272/2008 w sprawie klasyfikacji, oznakowania i pakowania substancji i mieszanin 2 . Błędy te należy zatem poprawić.

(2) Poprawiona zharmonizowana klasyfikacja i oznakowanie substancji powinny mieć zastosowanie od dnia wejścia w życie niniejszego rozporządzenia. Dostawcy nie powinni być zobowiązani do ponownego znakowania i pakowania substancji i mieszanin wprowadzonych do obrotu zgodnie z rozporządzenim (WE) nr 1272/2008 przed wejściem w życie niniejszego rozporządzenia. Niemniej jednak dostawcy powinni mieć możliwość zastosowania przepisów niniejszego rozporządzenia do substancji i mieszanin już wprowadzonych do obrotu na zasadzie dobrowolności.

(3) Środki przewidziane w niniejszym rozporządzeniu są zgodne z opinią komitetu ustanowionego art. 133 rozporządzenia (WE) nr 1907/2006 Parlamentu Europejskiego i Rady z dnia 18 grudnia 2006 r. w sprawie rejestracji, oceny, udzielania zezwoleń i stosowanych ograniczeń w zakresie chemikaliów (REACH), utworzenia Europejskiej Agencji Chemikaliów, zmieniającego dyrektywę 1999/45/WE oraz uchylającego rozporządzenie Rady (EWG) nr 793/93 i rozporządzenie Komisji (WE) nr 1488/94, jak również dyrektywę Rady 76/769/EWG i dyrektywy Komisji 91/155/EWG, 93/67/EWG, 93/105/WE i 2000/21/WE 3 ,

PRZYJMUJE NINIEJSZE ROZPORZĄDZENIE:

Artykuł  1

W części 3 załącznika VI do rozporządzenia (WE) nr 1272/2008 pozycje w tabeli 3.1 zmienione załącznikami I i II do rozporządzenia (WE) nr 790/2009, odpowiadające pozycjom wymienionym w załączniku I do niniejszego rozporządzenia, zastępuje się pozycjami wymienionymi w tym załączniku.

Artykuł  2

W części 3 załącznika VI do rozporządzenia (WE) nr 1272/2008 pozycje w tabeli 3.2 zmienione załącznikami IV i V do rozporządzenia (WE) nr 790/2009, odpowiadające pozycjom wymienionym w załączniku II do niniejszego rozporządzenia, zastępuje się pozycjami wymienionymi w tym załączniku.

Artykuł  3

Pozycje wymienione w załączniku III do niniejszego rozporządzenia dodaje się do tabeli 3.1 w części 3 załącznika VI do rozporządzenia (WE) nr 1272/2008.

Artykuł  4

Pozycje wymienione w załączniku IV do niniejszego rozporządzenia dodaje się do tabeli 3.2 w części 3 załącznika VI do rozporządzenia (WE) nr 1272/2008.

Artykuł  5

Dostawcy nie są zobowiązani do ponownego znakowania i pakowania substancji wymienionych w załącznikach do niniejszego rozporządzenia lub substancji lub mieszanin ich zawierających, jeżeli już wprowadzili je do obrotu zgodnie z rozporządzeniem (WE) nr 1272/2008 przed wejściem w życie niniejszego rozporządzenia.

Artykuł  6

Niniejsze rozporządzenie wchodzi w życie trzeciego dnia po jego opublikowaniu w Dzienniku Urzędowym Unii Europejskiej.

Niniejsze rozporządzenie wiąże w całości i jest bezpośrednio stosowane we wszystkich państwach członkowskich.
